I. General Provisions
1. This Privacy Policy governs the collection, processing, and storage of Users' personal data required to provide services electronically via the website www.tkholding.pl (hereinafter referred to as the Website).
2. The Website collects only the personal data necessary to provide and develop the services offered therein.
3. Personal data collected through the Website are processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation, hereinafter referred to as the GDPR) and the Personal Data Protection Act of 10 May 2018.

III. Purpose of Personal Data Collection 

1. Personal data are used for the following purposes: o register an account and verify the User's identity, o enable logging into the Website, o execute the service and e-services agreement, o communicate with the User (livechat, contact form, etc.), o send the newsletter (after the User has consented to receiving it), o operating a comment system, o providing social media services, o promoting the Administrator's offer, o marketing, remarketing, affiliation, o personalizing the Website for Users, o analytical and statistical activities, o debt collection, o establishing, pursuing, or defending against claims. 

2. Providing data is voluntary, but necessary to conclude a contract or use other functionalities of the Website. 

IV. Type of personal data processed The Administrator may process the User's personal data: name and surname, date of birth, address, email address, telephone number, and Tax Identification Number. 

V. Period of personal data processing Users' personal data will be processed for the following periods:
• where the basis for data processing is the performance of a contract – until the statute of limitations for claims following its execution;
• where the basis for data processing is consent – ​​until its revocation, and after revocation, until the statute of limitations for claims.
In both cases, the statute of limitations is 6 years, and for claims for periodic benefits and claims related to business operations – 3 years (unless specific provisions provide otherwise).
VI. Sharing Personal Data 1. Users' personal data may be transferred to entities affiliated with the Controller, its subcontractors, entities cooperating with the Controller, e.g., e-payment companies, courier/postal services, and law firms. 2. Users' personal data will not be transferred outside the European Economic Area (EEA). 

VII. User Rights 

1. The Website User has the right to: access, rectify, erase, restrict processing, transfer, object to processing, and withdraw consent at any time (which does not affect the lawfulness of processing based on consent before its withdrawal).
2. A notification of the User's exercise of the rights arising from the above rights should be sent to office@tkholding.pl.
3. The Administrator will comply or refuse to comply with the request promptly – no later than one month after receiving it.
4. The User has the right to file a complaint with the President of the Personal Data Protection Office if they believe that the processing violates their rights and freedoms (GDPR). 

VIII. Cookies 

1. The Website collects information using cookies – session, persistent, and third-party. 

2. Collecting cookies supports the proper provision of services on the Website and serves statistical purposes. 

3. Users can specify the scope of cookie access to their device in their browser settings. 

IX. Automated Decision-Making and Profiling
1. User data may not be processed in an automated manner that would result in any decisions being made about them.
2. User data may be profiled to customize content and personalize the offer after they have provided their consent.
X. Final Provisions
1. The Administrator has the right to make changes to the Privacy Policy, but Users' rights will not be limited.
2. Information about the changes will be published in a notice available on the Website.
3. In matters not covered by this Privacy Policy, the provisions of the GDPR and Polish law shall apply.
